California Claims After a Serious Pedestrian Collision
When a vehicle collision results in injury or death, investigators and insurance companies may review whether negligence contributed to the incident. California negligence claims generally require evidence showing a duty of care, a breach of that duty, causation, and resulting harm.
Depending on the evidence, affected families may need to consider:
- Medical expenses and other losses connected to an injury
- Available automobile or other applicable insurance coverage
- Evidence such as surveillance footage, witness statements, and crash reports
- A potential wrongful death claim for qualifying family members when negligence causes a death
Under California Code of Civil Procedure § 377.60, a spouse, domestic partner, children, and other qualifying heirs may bring a wrongful death claim when someone’s wrongful act or negligence causes a death. Recoverable damages depend on the family relationship, financial losses, and the circumstances of the case.
