California Crosswalk Laws and Wrongful Death Claims
The pedestrian accident raises important questions about pedestrian safety and potential civil liability. Under California Vehicle Code Section 21950, motorists must yield to pedestrians in marked crosswalks and exercise reasonable care to avoid collisions.
When a fatal collision involves possible negligence, surviving family members may have legal options, including:
- Wrongful death claims: Eligible relatives may seek compensation for losses resulting from another party’s negligence.
- Financial damages: Recoverable losses may include funeral expenses, loss of financial support, and loss of companionship.
- Evidence preservation: Police reports, surveillance recordings, and witness statements may help establish liability.
- Filing deadlines: California generally allows two years from the date of death to file a wrongful death lawsuit, although exceptions may apply.
Liability remains undetermined while the investigation continues.
