Wrongful Death and Injury Claims After a DUI Crash

A DUI-related criminal case is separate from any civil claim available to injured victims or surviving family members.

Under California Code of Civil Procedure § 377.60, qualifying relatives may file a wrongful death claim if a person’s death results from another party’s wrongful act or neglect. Personal injury claims may also be available to surviving crash victims.

Depending on the evidence and insurance coverage, compensation may include:

  • Medical expenses and future treatment related to crash injuries
  • Lost income and reduced earning capacity
  • Pain, suffering, and other accident-related losses
  • Wrongful death damages available to eligible surviving family members

California generally provides two years to bring actions involving personal injury or wrongful death, although exceptions may affect the deadline.
