Los Angeles, California — A Filipino-American health care worker has reached a tentative settlement in a workplace discrimination and harassment lawsuit against a Van Nuys nursing home.
Cynthia Batac, a 47-year-old former employee at Windsor Terrace Healthcare Center, alleged she endured repeated mistreatment from her supervisor, who reportedly regarded her as “too old” and “too ethnic.” Her complaint, filed in March 2023, detailed claims of workplace harassment, retaliation, and neglect of reported patient care concerns.
Her complaint outlined several key allegations:
- Batac claimed she experienced bias after voicing concerns about being overworked and the facility’s lack of sufficient staff.
- She stated that her superiors dismissed her efforts to report problems with patient care.
- According to the lawsuit, her June 2021 termination led to significant emotional and physical distress, including sleep disturbances and illness.
- The complaint also noted that she was replaced by a younger worker who was not Filipino.
The legal battle took a turn in August 2023 when the court compelled Batac to resolve the case through arbitration. Despite this, an agreement has since been reached. On Thursday, Batac’s legal team informed Los Angeles Superior Court Judge Tony Richardson of a “conditional” settlement. A formal dismissal of the case is expected by December 31.
